• Intellectual Property: You retain ownership of the content you share on our website, but you grant us a non-exclusive, royalty-free license to use, distribute, and display your content on our website.

Contest Entry:

In consideration for the opportunity to submit your story (the “Contest Entry”) whether in written, photographic, audio, video or digital format to Mismatched Online LLC and the opportunity to win a one week vacation on Cape Cod, or cash prizes being sponsored by Mismatched Online LLC and for other good and valuable consideration, you irrevocably grant Mismatched Online LLC and its agents and contractors all rights you have in those items and formats constituting my Contest Entry including the right and permission to use, copy, alter, distribute, publish, broadcast, and display the Contest Entry on the Mismatched Online website, elsewhere on the Internet, in advertising and promotional materials, and in any other medium or format for any purpose.

Upon Submission of your Contest Entry, you hereby grant all rights of ownership in the Contest Entry to Mismatched Online LLC and waive any right to royalties or other payment for the use of your Contest Entry. You also waive the right to inspect or approve Mismatched Online LLC’s use of the Contest Entry and other materials that Mismatched Online LLC may use with the Contest Entry.

You attest that there is no copyrighted material in your Contest Entry.

You release and waive and agree to hold Mismatched Online, LLC, its agents, and its contractors harmless from any claims, damages, or liabilities resulting from their use of the Contest Entry and you agree not to bring any such claims against the released parties at any time in the future. This includes but is not limited to: claims for compensation or restitution for the Contest Entry; claims for violation of publicity rights and privacy rights; claims based on moral rights; claims for intrusion; claims for defamation; claims for fraud; claims for infliction of emotional distress; and claims for copyright or other intellectual property infringement; whether those claims may be based on statutes or the common law.

You represent and warrant to Mismatched Online LLC that:

• You have not granted anyone else any rights to use, distribute, publish, broadcast, or display the Contest Entry in its whole or any part(s) thereof.
• You have all rights necessary to grant the rights, waivers, and releases granted in this Release and Waiver.
• You have read this Release and Waiver and you fully understand it.

Updates: We may update these Terms & Conditions from time to time, and your continued use of our website constitutes your agreement to any changes.
